DealHive Malawi (“DealHive”, “we”, “us”, “our”) respects your privacy and is committed to protecting your personal data. This Privacy Policy explains how we collect, use, disclose, and protect your information when you use the DealHive mobile application, website, or related services (“Service”).

By accessing or using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

2. Interpretation and Definitions

Words with capital letters have the meanings defined below, whether used in singular or plural form.

Account

A unique account created to access the Service.

Application

The DealHive software application.

Company / Data Controller

DealHive Malawi, headquartered in Blantyre.

Country

Republic of Malawi.

Device

Any device capable of accessing the Service, including a mobile phone, tablet, or computer.

Personal Data

Information relating to an identified or identifiable individual.

Service Provider

Any third party processing data on behalf of DealHive.

Usage Data

Data collected automatically through use of the Service.

You / User

The individual or legal entity accessing the Service.

4. Information We Collect

Optional information: Preferences and feedback provided voluntarily and only with consent. We may send a feedback form about your interaction with DealHive.

We use personal data to:

• Payment processors, such as PayChangu, Airtel Money, and TNM Mpamba
• Service providers under contractual confidentiality obligations

Where data is processed outside Malawi, this is done only under:

• Adequacy safeguards

9. Data Retention

Personal data is retained only for as long as necessary for service delivery, legal compliance, and regulatory obligations. Financial and transaction records are retained for a minimum of seven (7) years as required by law, after which data is securely deleted or anonymized.

• No system is 100% secure; however, we continuously work to protect your information

12. Children’s Data

DealHive does not intentionally collect sensitive personal data, such as health, religion, or political beliefs. If such data becomes necessary, explicit consent will be obtained and enhanced safeguards applied.

14. Data Breach Notification

If a data breach poses a high risk to users, DealHive will notify the relevant Malawian authority and affected users within 72 hours, in accordance with law.

15. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated through the platform or by email, and the effective date will be updated.

By accessing or using DealHive, you agree to these Terms of Use and the Privacy Policy.

2. Eligibility

You must be:

• At least 18 years old
• Aged 16–17 with verified parental or guardian consent

3. Account Responsibilities

You agree to:

• Provide accurate and complete information
• Keep login credentials confidential
• Notify DealHive of any unauthorized account use

4. Payments, Credits & Transactions

Payments are processed through approved mobile money providers.

• Credits purchased are non-refundable, except where required by Malawian law
• Credits are used to join deals
• Leaving a deal may result in a deduction of credits
• DealHive is not responsible for credits lost due to user error or failure to redeem

5. Deals & Redemption

Deal details, pricing, availability, and redemption terms are displayed on the platform.

• Redemption may require physical presence at a vendor location
• DealHive does not guarantee vendor stock outside the stated deal terms

6. User Conduct

You agree not to:

• Violate Malawian laws or third-party rights
• Engage in fraud or misrepresentation
• Attempt unauthorized access or system interference
• Upload malicious software or harmful content

7. Platform Modifications

DealHive reserves the right to:

• Modify, suspend, or discontinue features
• Update pricing or deal structures
• Suspend or terminate accounts for misuse or breaches

8. Disclaimers

The platform is provided “as is” and “as available.” DealHive makes no warranties regarding uninterrupted service, accuracy, or fitness for a particular purpose.

9. Limitation of Liability

DealHive shall not be liable for indirect, incidental, or consequential damages. Total liability is limited to the amount paid by the user in the preceding twelve (12) months, where permitted by law.

10. Intellectual Property

All content, trademarks, and intellectual property belong to DealHive or its licensors. Unauthorized use is prohibited.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Malawi. Disputes shall be resolved through Malawian courts or alternative dispute resolution mechanisms where applicable.

12. Electronic Transactions

Electronic records, communications, and signatures on DealHive are legally valid and enforceable under Malawian law.

13. Notices

Official notices may be sent by email, SMS, or platform notifications and are deemed received within 24 hours.
